These Terms govern your use of Driifloat Manager, the Driifloat and Driifloat Manager mobile apps, Driifloat booking pages and the booking widget on facility websites. By creating an account or using the Services you accept these Terms. If you use the Services for a facility, you confirm that you are allowed to accept them on the facility’s behalf.

1. Who we are and what these Terms cover

The Services are provided by Driifloat spółka z ograniczoną odpowiedzialnością (Driifloat sp. z o.o.), ul. Leśna 3, 95-040 Koluszki, Poland, registered in the National Court Register (KRS) under number 0000989408 by the District Court for Łódź-Śródmieście in Łódź, NIP 7282865475, REGON 522934158, share capital PLN 5,000 (“Driifloat”, “we”, “us”). You can reach us at support@driifloat.com.

These Terms are our rules for providing services by electronic means. They apply to customers who book sessions and to facilities and their staff. Some sections apply only to one group, as their headings say. The purchase or lease of Driifloat units is governed by the separate contract for those units.

2. Definitions

  • Services: Driifloat Manager, the Driifloat and Driifloat Manager apps, booking pages, the booking widget, the Driifloat API, and the online services that connect to Driifloat units.
  • Facility: a business that offers sessions on Driifloat units and uses Driifloat Manager.
  • Staff: people a facility gives access to its Manager account.
  • Customer: a person who books or takes a session at a facility, with or without an account.
  • Session: the dry-floatation service a facility provides on its premises.

3. The Services

Depending on how you use them, the Services let you:

  • find facilities and book, pay for, reschedule and cancel sessions;
  • as a facility, manage units, programs, opening hours, staff, customers, bookings, payments, audio and notifications;
  • start and control sessions on units, run units in kiosk mode, and set up new units with the Driifloat Manager app;
  • publish a booking page and embed the booking widget on a facility’s own website, and connect other systems through the API.

Driifloat is a technology provider. The facility you book with provides the session: its premises, staff, equipment, prices, availability and policies. Driifloat is not a party to the agreement for the session.

Customers can use the Services free of charge. For facilities, the software is included with Driifloat units. If we introduce paid features, we will show the price and terms before you can buy them.

4. Technical requirements

To use the Services you need an internet connection, an email address and either a current version of Chrome, Safari, Firefox or Edge with JavaScript and cookies enabled, or the Driifloat app on a supported version of iOS or Android. Setting up units with the Driifloat Manager app also needs Bluetooth. Units need a working network connection to receive sessions and updates.

Like any online service, the Services carry risks such as malware, phishing and unauthorised access to accounts. Keep your devices updated and never share your password.

5. Accounts

You must be 18 or older to hold an account and must give accurate information. An adult may book a session for someone under 18 where the facility allows it. Keep your sign-in details private and tell us at once if you think someone else has used your account. You are responsible for what happens in your account unless the law says otherwise.

The agreement for an account starts when you create it and lasts until the account is deleted. You can stop using the Services at any time and delete your account in the apps or in Settings, as described on driifloat.com/delete-account, or by emailing support@driifloat.com.

6. Bookings and payments for customers

A booking is subject to availability. It is confirmed when the Services show it as confirmed or, where the facility approves bookings manually, when the facility accepts it. A time slot may be held for a short time while you pay; if payment is not completed in that time, the slot is released.

The agreement for the session is between you and the facility. The facility’s prices and its cancellation, rescheduling, no-show, payment and refund policies apply, and are shown before you book. Questions and complaints about the session itself, and refunds, are handled by the facility; we will help you reach it where we can.

Where a facility takes payments online, you pay the facility through Stripe; Driifloat does not receive the money or take a fee. A facility may ask for full payment, a deposit, or a saved card as a guarantee. If you accept the facility’s card terms, the facility may charge your saved card for a late-cancellation fee, a no-show fee or an unpaid balance, as stated in the policy shown when you booked.

If you are a consumer, the right to withdraw from a contract within 14 days may not apply to a session booked for a specific date or time. This is between you and the facility and does not affect your other rights under consumer law.

Links in booking emails let anyone who has them view and manage the booking. Do not share them.

7. Facilities

This section applies to facilities and their staff, who use the Services as a business and not as consumers.

  • Accounts and staff. The facility owner is responsible for the facility account, its settings and its staff. Each person must use their own account. Remove access promptly when someone no longer needs it. Keep API keys and kiosk PINs secret.
  • Your content. You are responsible for the accuracy and lawfulness of the facility information, images, programs, prices and policies you publish, and for complying with the consumer law that applies to you as a trader, including information you must give customers before they book.
  • Customer information. You decide what you ask customers and what you do with their information, and you must have a lawful basis for it. Do not use intake questions or notes to collect health or other sensitive information unless you have confirmed that this is lawful and appropriate.
  • Payments. To take payments online you connect your own Stripe account and accept Stripe’s terms. Payments are made to you. You are responsible for your prices, taxes, receipts, refunds, chargebacks and disputes. Driifloat does not take a fee from these payments and is not responsible for Stripe’s service.
  • Music. You must have the rights needed to play any music you upload or stream on your units in your premises, including public-performance licences where they are required. Spotify Connect uses your own Spotify account, requires Spotify Premium, and is subject to Spotify’s terms, which may limit use to personal, non-commercial listening.
  • Units and software. Driifloat may update the software on your units and in the Services, including automatically, to fix problems, improve security and add features.
  • Third-party services you turn on, such as ntfy alerts or embedding the booking widget on your website, are your choice and subject to their own terms.

8. Data processing for facilities

For personal information about a facility’s customers and bookings, the facility is the controller and Driifloat processes it on the facility’s behalf as a processor. This section forms the data processing agreement required by Article 28 of the GDPR (and the UK GDPR) between Driifloat and each facility.

  • Subject and duration: providing the Services to the facility, for as long as the facility uses them and until the data is deleted or returned.
  • Data and people: contact, booking, session, payment-record and customer-record information about the facility’s customers and staff, as described in the Privacy Policy.
  • Instructions: we process the data only on the facility’s documented instructions, which are these Terms and the facility’s use and settings of the Services, unless the law requires otherwise; we will tell the facility if we think an instruction breaks the law.
  • Confidentiality and security: people who access the data are bound by confidentiality, and we apply appropriate technical and organisational measures, including encryption in transit, access control and restricted, logged support access.
  • Sub-processors: the facility gives general authorisation for the sub-processors listed in the Privacy Policy. We bind them to equivalent data protection terms, give at least 30 days’ notice of new ones by updating that list and emailing the facility owner, and the facility may object; if we cannot address the objection, the facility may stop using the Services.
  • Assistance: we help the facility respond to requests from individuals, and with security, breach notification, impact assessments and consultations with authorities, as far as reasonable given the information available to us.
  • Breaches: we notify the facility without undue delay after becoming aware of a personal data breach affecting its data.
  • Transfers: data may be processed outside the EEA only with the safeguards described in the Privacy Policy.
  • End of use: when the facility stops using the Services, we delete or return its data within 90 days at its choice, unless the law requires us to keep it.
  • Audits: we make available the information needed to show compliance with this section and allow reasonable audits, with reasonable notice and at the facility’s cost.

9. Acceptable use

You must not use the Services to:

  • break the law or provide unlawful content;
  • impersonate anyone, make fake or abusive bookings, or send spam;
  • scrape data, get around booking, payment or security controls, or access information you are not allowed to see;
  • probe, overload or disrupt the Services or units, or upload malicious code;
  • copy, resell or reverse engineer the Services, except where the law allows it.

10. Content and intellectual property

Driifloat and its licensors own the Services, the software on the units, and Driifloat names, logos and materials. While you follow these Terms, you may use the Services for their intended purpose.

You keep the rights to the content you add. You give Driifloat a non-exclusive licence to host, store, display, resize and otherwise process it as needed to run the Services, for as long as it is in the Services. If you send us feedback, we may use it without obligation.

11. Availability, changes and ending use

We work to keep the Services available but cannot promise that they will always be uninterrupted or error-free, or work on every device. We may change, maintain or update the Services.

We may suspend or end access where needed for security, to stop fraud or unlawful activity, after a serious or repeated breach of these Terms, or because the law requires it. Where reasonable, we will tell you first and give you a chance to fix the problem.

We may change these Terms for good reasons, such as new features, changes in the law or security needs. We will publish the new version and, for facility accounts and other significant changes, tell you by email at least 14 days before it takes effect. If you do not agree, you can stop using the Services and delete your account before then.

12. Complaints

You can send complaints about the Services to support@driifloat.com. Please describe the problem and how to contact you. We reply within 14 days. Complaints about a session go to the facility.

13. Liability

Driifloat is not responsible for the facility’s sessions, premises, staff, prices or policies.

Consumers. Nothing in these Terms limits your rights under mandatory consumer law, or our liability for damage caused intentionally, for death or personal injury caused by negligence, or for anything else that cannot be limited by law.

Facilities. To the extent the law allows, Driifloat is not liable to facilities for lost profits, lost revenue, lost data that could have been restored from the facility’s own records, or indirect loss, and its total liability to a facility under these Terms in any 12 months is limited to EUR 1,000. This does not limit liability for damage caused intentionally or any other liability that cannot be limited by law.

A facility will cover Driifloat’s reasonable costs of claims by third parties that arise from the facility’s content, its use of customer information, or its breach of these Terms or the law.

14. Governing law and disputes

These Terms are governed by Polish law. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and may bring proceedings in its courts. You may also use out-of-court complaint and redress procedures available in your country.

Disputes with facilities are decided by the courts with jurisdiction over Driifloat’s registered office.

15. General

If a court finds part of these Terms invalid, the rest still applies. You may not transfer your rights under these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of our business. These Terms are the whole agreement between you and Driifloat about the Services. They do not replace the contract for Driifloat units or the agreement between a customer and a facility for a session.

Our point of contact for authorities, users and facilities, including under the EU Digital Services Act, is support@driifloat.com. You can write to us in English or Polish.
